Terms of Service

Effective Date: October 1, 2026

These Terms govern use of the Kavimia website, the Kavimia Order Messaging free plugin, Kavimia Order Messaging Pro, associated services, licenses, downloads, updates, and support. By purchasing, downloading, activating, or using Kavimia Order Messaging, you agree to these Terms.

  1. Seller. Netanel Amram, licensed dealer (osek murshe), Kavimia, Siglit 1212, Mazkeret Batya, Israel. Email: [email protected].
  2. Kavimia Order Messaging Free. May be distributed through WordPress.org or other authorized channels. It remains usable without purchasing Kavimia Order Messaging Pro. A Pro subscription is not required to continue using functionality included in the Free version.
  3. Kavimia Order Messaging Pro Plans. Unless otherwise stated on the checkout page, annual pricing is: 1 website – USD $59 per year; 5 websites – USD $129 per year; Unlimited websites – USD $249 per year. Applicable taxes may be added by Freemius according to the buyer's location and applicable law. Prices may change for future purchases or renewals; existing customers will receive any notice required by applicable law or the applicable checkout terms.
  4. Annual Subscription and Automatic Renewal. Pro is sold as an annual subscription unless expressly stated otherwise. Subscriptions automatically renew at the end of each billing period unless renewal is cancelled before the renewal date. Freemius manages payment processing, subscription administration, licensing, and renewal transactions as merchant of record. Because Freemius acts as merchant of record, the payment confirmation, receipt or tax documentation for a purchase may be issued by Freemius and the purchase is also subject to the buyer terms presented during checkout.
  5. Cancelling Renewal. Cancelling automatic renewal prevents the next subscription charge. Based on the current licensing model, cancelling renewal alone does not immediately terminate the already-paid license period. The Pro license may continue to operate until the end of the current paid subscription period.
  6. Cancelling or Deactivating the Pro Licence. Cancelling or revoking the Pro license itself is different from cancelling renewal. If the Pro license is cancelled, revoked, refunded, expires, becomes invalid, or otherwise loses entitlement, Pro-only functionality may stop operating immediately or when the licensing system next synchronizes. Kavimia Order Messaging Free remains available and may continue to operate independently.
  7. WordPress and GPL Licence. Kavimia Order Messaging is WordPress software distributed under the GNU General Public License, version 2 or later, or another GPL-compatible license where specified. Your payment for Pro primarily purchases commercial access to: Pro functionality in the purchased version; licensing and activation services; updates during the subscription period; access to eligible downloads; support under the applicable plan. Nothing in these Terms removes rights granted to you under the applicable open-source license for code you have lawfully received.
  8. Third-Party Services. Kavimia Order Messaging depends on third-party software and services, including WooCommerce, WordPress, Meta's WhatsApp Cloud API, and Freemius. We do not control them; their APIs, policies, pricing, approval requirements, availability, limits, or technical behavior may change.
  9. Meta and WhatsApp Responsibilities. You are responsible for: maintaining your own Meta and WhatsApp Business accounts where required; obtaining and protecting your own access credentials; complying with Meta and WhatsApp policies; obtaining approval for message templates where required; obtaining customer consent or another lawful basis for messages; ensuring the content and recipients of your communications are lawful; complying with anti-spam, privacy, consumer-protection, and electronic-communications laws applicable to your business. Kavimia Order Messaging does not guarantee that Meta will approve a template, deliver a message, keep an account active, or continue offering a particular API or feature.
  10. No Delivery Guarantee. A message marked as sent by Kavimia Order Messaging indicates that a request was accepted at the applicable technical stage. It does not guarantee that the recipient read or received the message. Delivery may be affected by Meta, WhatsApp, network conditions, recipient settings, account restrictions, template status, invalid numbers, outages, or other third-party factors.
  11. Updates and Compatibility. We aim to maintain reasonable compatibility with supported versions of WordPress and WooCommerce. We do not guarantee compatibility with every theme, plugin, hosting configuration, PHP version, custom checkout implementation, or third-party extension.
  12. Support. Support may be provided through the contact method published by Kavimia. Unless an explicit service-level agreement is purchased separately, no guaranteed response or resolution time applies.
  13. Acceptable Use. You may not use Kavimia Order Messaging to: violate applicable law; send unlawful spam or deceptive communications; harass or threaten individuals; circumvent Meta or WhatsApp restrictions; gain unauthorized access to systems; distribute malware; interfere with Kavimia Order Messaging, WordPress, Meta, Freemius, or other services.
  14. Suspension. We may suspend access to commercial services or Pro licensing where reasonably necessary because of fraud, chargebacks, abuse, violation of these Terms, security risks, unlawful conduct, or non-payment. Mandatory statutory rights remain unaffected.
  15. Disclaimer of Warranties. To the maximum extent permitted by applicable law, Kavimia Order Messaging is provided "as is" and "as available". We do not warrant uninterrupted or error-free operation, guaranteed delivery, guaranteed Meta approval, or compatibility with every third-party system. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
  16. Limitation of Liability. To the maximum extent permitted by law, Kavimia and Netanel Amram will not be liable for indirect, incidental, consequential, special, or loss-of-profit damages arising from third-party outages, failed message delivery, Meta restrictions, merchant configuration, or misuse of the software. Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
  17. Privacy. Use of Kavimia Order Messaging is also subject to the Kavimia / Kavimia Order Messaging Privacy Policy.
  18. Changes. We may update these Terms from time to time. Material changes will be communicated where required by law.
  19. Governing Law. These Terms are governed by the laws of the State of Israel. Disputes shall be handled by the courts having lawful jurisdiction in Israel, subject to any mandatory consumer-law or jurisdictional rights that cannot be waived.
